According to the affidavit, Eatherly, 28, who films content, including racially charged content on Broadway, was asked by the restaurant not to live-stream or be disruptive to the dining service.

After ordering two full entrees, drinks and appetizers, totaling $371.55, the restaurant realized he had been live-streaming and asked him to stop.

According to the affidavit, Eatherly became disruptive and started making racial statements, yelling, screaming and creating a scene.

Eatherly then reportedly made statements of not paying for his food, which he consumed during his time at the restaurant, according to the affidavit.

The affidavit said Eatherly intended to deprive, withhold and otherwise refused to make a payment for the meal he had consumed.

Eatherly was charged with disorderly conduct, resisting arrest and theft of services. Eatherly was booked on a bond totaling $5,000.
